Subject: 9721 /Access Requirements/RT-1 Zone Date: Tue, 24 Apr 1990 11:55:00 -0500 ORDINANCE NO. 9721 AN ORDINANCE TO AMEND ORDINANCE NO. 6958, AS AMENDED, THE ZONING ORDINANCE, SO AS TO AMEND ARTICLE V, SECTION 123 RELATIVE TO ACCESS REQUIREMENTS FOR THE RT-1 ZONE. __________________________ WHEREAS, there is conflicting statements within the RT-1 Zone regulations, one of which states that townhouse developments of more than 8 "should" be located within 500' of a major arterial or collector street, the other which states that the development "must" be located within 500'; and WHEREAS, the language which states "should be" is part of a more recent amendment than the language which states "must be"; and WHEREAS, there are potentially many situations where it would be reasonable to allow such developments on or near certain streets which are not designated as major arterials or collectors; and WHEREAS, The Chattanooga-Hamilton County Regional Planning Commission has reviewed a proposed amendment to the Chattanooga Zoning Ordinance and recommends said amendment to the Chattanooga City Council; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That Ordinance No. 6958, as amended, the Zoning Ordinance, be and the same is hereby amended as follows: SECTION 1. That Article V, Section 123, subsection (8), as follows, is deleted in its entirety (8) Any townhouse development of more than eight (8) units must be located within five hundred (500') feet of a major arterial or collector street, road or highway as shown on the General Plan most recently adopted by the Planning Commission.
